Scope
These terms govern the use of Private-Samenspende.at. By registering you accept them in their current version.
Requirements
You confirm that you are at least 18 years old and fully legally competent (FMedG §13). Only one account per person is permitted. Information in your profile must be truthful.
Personal responsibility
The platform provides a technical framework for making contact. All decisions about donation, meetings, medical examinations, and legal agreements are made by members on their own responsibility. We do not provide medical, legal, or psychological advice and are not involved in any donation.
Prohibited use
In particular the following are prohibited: commercial brokering or sale of sperm (FMedG §16(2)), false identity information, harassment, discrimination or threats against other members, uploading unlawful content, and automated data collection. Violations lead to immediate suspension.
Member content
Members are solely responsible for the profiles, photos, and messages they publish. You grant us a simple, non-transferable right to store your content and display it to authorised members exclusively for the operation of the platform.
Verification
Verifications are a trust indicator, not a guarantee. We check plausibility but accept no warranty as to the substantive accuracy of medical statements made by third parties.
Liability
The platform is provided free of charge and without any profit-making intention. We are liable only for intent and gross negligence. Liability for damages arising from the use of the platform, from contact between members, from donation procedures, or from any personal, health-related, or legal consequences thereof, is excluded to the extent permitted by law.
Termination
You can delete your account at any time without giving reasons. We reserve the right to suspend accounts without prior notice in case of rule violations or substantiated suspicion.
Changes
Material changes to these terms will be announced by email with reasonable advance notice.
Governing law
Austrian law applies, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. Place of performance and exclusive jurisdiction is, to the extent permitted by law, Vienna.
